Contest Rules

Massachusetts state law requires certain disclosures to protect all participating parties resulting in the following rules and regulations. Please see below.

  1. Eligibility

    No purchase necessary to enter or win. Prospective entrants must follow  @capeyachts and @nautijanes on Instagram, like the contest announcement post, and tag at least one other Instagram User. Persons under 21 and employees and affiliates of Cape Yachts or South Wharf Yacht Yard are not eligible to participate. The contest is not open to international participation. Entrants need not be present to win. Past winners of contests are not eligible to win.

  2. Qualification Period

    The qualification period begins when the Instagram contest content is posted on the @capeyachts Instagram account and ends the same day the following week at 11:59 pm. (December 6th @ 8pm)

  3. Entry Procedures

    Prospective entrants who meet the eligibility criteria must tag Instagram users in the comments section of the contest announcement post. Each tagged user represents one entry for the prospective entrant. Multiple entries are permitted and encouraged.
    If the original entry criteria cannot be met, entries will be accepted in person on December 6th from 4:00 PM to 7:45 PM at the Cape Yachts office at 218 Elm Street, during the Padanaram Christmas Stroll. This alternate entry requires the completion of a form with the entrant’s name, email, and phone number. Additionally, a photograph of the entrant with a Cape Yachts team member will be taken and posted on the Nauti Janes Instagram Story, which remains visible for 24 hours.

  4. Duties of Participants; Limitation of Liability

    By entering, participants agree to be bound by these rules and the decisions of Cape Yachts which shall be final. All federal, state, and local laws apply. Cape Yachts and its employees and representatives are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Cape Yachts that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest.

  5. Violation of Contest Rules

    Cape Yachts reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, or acts in an unsportsmanlike or disruptive manner.

  6. Selection of Winners; Chances of Winning

    One (1) winner will be selected at random among all entries received for each contest period. Odds of winning depend on number of entries received.

  7. Description of Prizes

    The giveaway winner will receive a half-day (4-hour) boat trip on Wellcraft 262 with a   captain provided, awarded as a gift certificate. The certificate is valued at $1,015 (inclusive of rental and captain fees) and is valid for 10 months starting on December 6th, 2024. The entire trip (4-hours) must be used at once.

  8. Notification of Winners; Substitution of Prizes

    One (1) winner will be notified and announced via a public-facing congratulatory post on Instagram the day the winner is drawn. Cape Yachts will notify the winner one time in this public post. If any winner does not respond within seven days of notification, the prize will be forfeited. Prizes are not transferable.

  9. Winners may not substitute prizes.

    Cape Yachts reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. All taxes on prize are winners’ responsibility. Limit on prize per household.

  10. Permissions

    Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, photography, and likenesses for online posting, and/or any advertising and publicity without additional compensation. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.
